1. Introduction and Acceptance

Welcome to NB Stationery. These Terms of Service ("Terms") govern your access to and use of the NB Stationery website, mobile applications, and all associated services (collectively, the "Service") operated by NB Stationery ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

These Terms constitute a legally binding agreement between you and NB Stationery. We reserve the right to modify these Terms at any time, and such modifications shall become effective immediately upon posting on the Service. Your continued use of the Service following any modifications indicates your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any changes.

By using the Service, you represent and warrant that you meet these age requirements. Failure to provide satisfactory verification may result in the suspension or termination of your account and access to the Service. Additionally, the Service is intended for personal and commercial use by individuals and businesses located in jurisdictions where such use is not prohibited by law.

3. Account Registration and Security

You are solely responsible for all activities that occur under your account, whether or not you have authorized such activities. This includes purchases made, information submitted, and any interactions with other users or third-party services through your account.

4. Products and Pricing

All products offered through the Service are subject to availability. We make every effort to display our products accurately, including their colors, dimensions, and materials. However, we cannot guarantee that your device's display will accurately reflect the actual appearance of products. Minor variations in color, texture, and size may occur between the displayed product and the actual item received.

Prices for products are listed in the applicable currency and are subject to change without prior notice. We reserve the right to modify prices at any time. All prices are exclusive of applicable taxes, duties, and shipping charges unless otherwise stated. Tax calculations and applicable rates are determined at the time of checkout based on your shipping address and local tax regulations.

While we strive to ensure the accuracy of all pricing information, errors may occur. In the event that a product is listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel orders placed for the product at the incorrect price, regardless of whether the order has been confirmed or your payment method has been charged. If your payment method has already been charged for the purchase and we cancel your order, we will issue a refund in the full amount of the erroneous charge.

5. Orders and Payment

Please note that an order confirmation does not constitute acceptance of your order; it merely acknowledges that we have received your order. We reserve the right to limit the quantities of any products purchased per person, per household, or per order.

6. Intellectual Property

All content available on the Service, including but not limited to text, graphics, photographs, images, illustrations, logos, trademarks, trade names, service marks, product names, designs, and software (collectively, "Content"), is the property of NB Stationery or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Content for personal, non-commercial purposes only. This license does not include the right to collect or use any product listings, descriptions, or prices for any commercial purpose; copy, reproduce, distribute, display, or create derivative works from any Content; download or copy account information for the benefit of another merchant or business; or use any data mining, robots, or similar data gathering and extraction tools on the Service.

Any unauthorized use of the Content or the Service may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties. We reserve all rights not expressly granted to you under these Terms.

7. Prohibited Conduct

You agree not to engage in any of the following activities in connection with your use of the Service: using the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation; attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service; using the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.

Additionally, you agree not to upload, post, or transmit any content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable; impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity; use any automated means, including robots, crawlers, or data mining tools, to access, monitor, or copy any content or information from the Service; or attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, NB Stationery, its officers, directors, employees, agents, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of or inability to use the Service.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the total amount paid by you to NB Stationery during the twelve (12) months preceding the event giving rise to the liability. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless NB Stationery, its officers, directors, employees, agents, affiliates, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, your violation of any third-party right including intellectual property rights, or any content you submit through the Service.

10. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiations between the parties. If such negotiations fail, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Almaty, Republic of Kazakhstan.

You agree that any cause of action or claim arising out of or related to these Terms or the Service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

11. Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service, or any part thereof, at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. We may also terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent as closely as possible.

These Terms, together with our Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and NB Stationery regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
